在动力电池产业的闭环发展已成为全球共识的背景下,随着中国动力电池产业的快速崛起,中国企业正加速出海设立电池工厂,下一步还将在海外设立动力电池回收站和再利用工厂,以实现产业闭环的本土化发展。为了探究中国动力电池回收出海所面临的专利风险和技术保护等相关问题,本文选取以出海美国为例进行分析,利用incoPat数据库检索获得了美国在动力电池回收技术方面的专利数据,通过专利分析的方法,研究梳理了专利申请情况、竞争态势、关键专利布局,以及重点创新主体。在此基础上结合政策和产业信息,分析研判我国企业出海美国时面临的专利侵权风险和专利布局风险,并尝试提出应对专利风险、保护自身技术的建议措施,为我国动力电池回收出海决策提供信息支持和参考。
Abstract:Under the background that the closed-loop development of the power battery industry has become a global consensus, with the rapid rise of China's power battery industry, Chinese enterprises are speeding up the establishment of battery factories at sea. In the next step, they will set up power battery recycling stations and recycling plants overseas to realize the localization development of closed-loop industry. In order to explore the patent risks and technical protection and other related issues faced by China's power battery recycling to the sea, this paper takes the United States as an example to analyze,and uses the inco Pat database to retrieve the patent data of the United States in the power battery recycling technology. Through the patent analysis method, this paper studies and sorts out the application status, competition situation, key patent layout, and key innovation applicants. On this basis, combined with policy and industry information, this paper analyzes and judges the patent infringement risks and patent layout risks faced by Chinese enterprises when they go to the United States, and tries to put forward suggestions and measures to deal with patent risks and protect their own technology,so as to provide information support and suggestions for China's power battery recycling to the sea decision.
